Construction Litigation

The firm's construction law practice represents any party to a construction contract, prosecuting or defending claims on behalf of owners, contractors and other providers. We regularly advise and represent clients in disputes over project delays, acceleration or compression of schedules, cost overruns, change orders and extra work, disruption and loss of labor productivity, differing site conditions, defective design or construction, unacceptable workmanship or substituted materials, termination and default, and mechanics' liens and payment bond claims.

We represent owners and developers, general contractors, subcontractors or suppliers in situations involving threatened termination or alleged default. While exploring all remedies to prevent contract termination, we advise clients on the prudent steps to protect their rights and significantly reduce potential liabilities if the contractor relationship cannot be salvaged. We have represented owners facing contract termination because of delays, cost overruns, failure to provide materials or manpower, failure to build to specs, or other performance issues; builders determining whether to terminate a non-performing subcontractor; and subcontractors facing termination from the general contractor or the owner.

Construction defect and design defect litigation can hinge on technical interpretation of design specs, product specs, engineering decisions and builder contracts. Our firm has successfully shielded builders and design firms who were facing substantial exposure in construction disputes. We have won damages or cure on behalf of buyers/owners who discovered design defects or construction defects. We have litigated a wide range of commercial, industrial and residential design and construction defect cases, such as collapsing foundations or structures; soil settling and erosion; and plumbing, HVAC and insulation failures.

Finally, the firm asserts and enforces lien rights and payment bond rights on behalf of general contactors, subcontractors and any party not being paid for supplying materials or labor to a project. We also file liens for construction managers and design team members.
